Smart FIRE Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Smart FIRE website, the Smart FIRE web application (including any Progressive Web App installation) and the Smart FIRE Android mobile application (collectively, the “Service”).

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.


1) What Smart FIRE is (and is not)

Smart FIRE is a personal finance / financial independence planning tool that lets you input lifestyle and investment assumptions and simulates outcomes year-by-year to estimate when retirement could be feasible, taking into account factors like inflation, cost of living adjustments, market crises, asset tax rates, and legacy goals.

Not financial advice. The Service provides general, educational outputs and forecasts based on assumptions and simplified models. It is not investment, tax, legal, or financial advice, and it is not a substitute for a qualified professional.

You are solely responsible for your decisions, actions, and outcomes.


2) Eligibility

You must be at least 16 years old to use the Service. If you are under the age of majority in your country, you represent that you have permission from a parent or legal guardian.


3) Accounts and security

Some features may require an account. You agree to:

  • provide accurate information,
  • keep your credentials confidential,
  • promptly notify us of unauthorized access to your account.

You are responsible for all activity occurring under your account.


4) Your inputs, assumptions, and responsibility

You understand and accept that:

  • outputs depend entirely on your inputs and assumptions,
  • real markets, inflation, taxes, and personal circumstances can diverge materially from any simulation,
  • the Service may be wrong, incomplete, outdated, or not suitable for your jurisdiction.

You should treat results as a scenario exploration tool—not a promise.


5) Acceptable use

You agree not to:

  • misuse the Service (reverse engineer, disrupt, overload, or circumvent security),
  • attempt unauthorized access to systems or accounts,
  • use the Service for unlawful purposes,
  • upload or transmit malware or malicious code,
  • scrape, crawl, or harvest data except as permitted by law and by robots exclusions (if any).

We may suspend or terminate access if we reasonably believe you violated these Terms.


6) Offline/PWA use and device responsibility

The web application may function as a Progressive Web App and may support core features offline.
Offline access may store certain data locally on your device (e.g., browser storage/cache). You are responsible for:

  • securing your device,
  • using OS-level locks,
  • understanding that local device compromise can expose locally stored data.

7) Data and privacy

Our handling of personal data is described in the Privacy Policy, which forms part of these Terms. If you do not agree with the Privacy Policy, do not use the Service.

(Operator note: if you’re targeting EU users, make sure your Privacy Policy is GDPR-grade and not generic filler. Your current page looks like template text.)


8) Intellectual property

Except for content you provide, the Service (including software, UI, design, logos, and documentation) is owned by the Operator and protected by applicable IP laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, unless we explicitly allow otherwise.

You may not copy, modify, distribute, sell, lease, or create derivative works from the Service except where permitted by law or with our written permission.


9) User content (if applicable)

If the Service allows you to submit content (e.g., notes, comments, uploaded data), you retain ownership of your content. You grant us a license to host, store, and process that content solely to provide and improve the Service.

You represent you have the rights needed to submit the content and that it does not violate law or third-party rights.


10) Third-party services

The Service may integrate or link to third-party services (e.g., authentication providers, analytics, hosting, app stores). We are not responsible for third-party services and your use of them may be governed by their own terms.


11) Fees, subscriptions, and future paid features

The Service may be free today and paid tomorrow. If we introduce paid features, we will disclose pricing and billing terms at the point of purchase.

If you purchase a subscription:

  • subscriptions renew automatically unless canceled before renewal (where applicable),
  • you are responsible for taxes and fees imposed by your payment method or platform.

Android / app-store purchases: If you purchase through an app store, billing and refunds may be handled by the platform under its policies.

(Operator note: if you sell to EU consumers, you must handle consumer-rights disclosures properly. Don’t wing this.)


12) Availability, changes, and beta features

We may change, suspend, or discontinue any part of the Service at any time, including features, models, and assumptions used in calculations. Outputs may change as the algorithm evolves.

Some features may be labeled beta or experimental and may be less reliable.


13) Disclaimers

To the maximum extent permitted by law:

  • The Service is provided “as is” and “as available.”
  • We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We do not warrant that the Service will be uninterrupted, error-free, or that outputs will be accurate, complete, or suitable for your needs.

14) Limitation of liability

To the maximum extent permitted by law, the Operator will not be liable for:

  • investment losses, missed opportunities, lost profits, or any indirect, consequential, special, or punitive damages,
  • inaccuracies in projections or outputs,
  • decisions you make based on the Service.

If liability cannot be excluded, it is limited to the amounts you paid to the Operator for the Service in the 12 months preceding the event giving rise to liability (or €50 if you paid nothing), unless applicable law requires otherwise.

Nothing in these Terms limits liability that cannot be limited under applicable law (e.g., intentional misconduct, gross negligence, certain consumer protections).


15) Indemnity

If you use the Service unlawfully or in breach of these Terms, you agree to indemnify and hold harmless the Operator from claims, damages, liabilities, and expenses arising from your breach, your content, or your misuse.


16) Termination

You may stop using the Service at any time.

We may suspend or terminate your access:

  • if you violate these Terms,
  • if required by law,
  • to protect the Service, other users, or the Operator.

Upon termination, your license ends and you must stop using the Service. Data handling after termination is governed by the Privacy Policy and applicable law.


17) Android app specific terms

If you use the Smart FIRE Android application, you acknowledge:

  • the app may be distributed through a third-party platform and subject to that platform’s rules,
  • updates may be required to continue using the app,
  • device permissions (network, storage, notifications, etc.) are controlled by your device settings; declining certain permissions may limit features.

You also agree to comply with the terms of the platform from which you download the app (for example, Google Play), in addition to these Terms.


18) Governing law and jurisdiction

These Terms are governed by the laws of [Insert country/state], excluding conflict-of-laws rules.

Jurisdiction: Courts of [Insert city/country], unless mandatory consumer protection laws grant you the right to bring claims in your place of residence.


19) Changes to these Terms

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you (e.g., in-app notice). Your continued use of the Service after the effective date of updated Terms constitutes acceptance.
